{"id":128816,"date":"2024-11-23T12:31:00","date_gmt":"2024-11-23T17:31:00","guid":{"rendered":"https:\/\/elinformanteperu.com\/?p=128816"},"modified":"2024-11-23T12:31:00","modified_gmt":"2024-11-23T17:31:00","slug":"poder-judicial-dicta-24-meses-de-prision-preventiva-contra-mateo-castaneda","status":"publish","type":"post","link":"https:\/\/elinformanteperu.com\/index.php\/2024\/11\/23\/poder-judicial-dicta-24-meses-de-prision-preventiva-contra-mateo-castaneda\/","title":{"rendered":"Poder Judicial dicta 24 meses de prisi\u00f3n preventiva contra Mateo Casta\u00f1eda"},"content":{"rendered":"<p><span style=\"color: #000000;\"><strong>Lima, 23 Noviembre 2024, (ANDINA).-<\/strong> Poder Judicial, a trav\u00e9s del Primer Juzgado de Investigaci\u00f3n Preparatoria Nacional, dict\u00f3 24 meses de prisi\u00f3n preventiva contra el abogado Mateo Casta\u00f1eda Segovia y 36 meses contra Noriel Chingay Salazar, investigados por organizaci\u00f3n criminal y otro.<\/span><\/p>\n<p><span style=\"color: #000000;\">La decisi\u00f3n fue emitida por el juez Richard Concepci\u00f3n Carhuancho, quien dispuso que se oficie a la Polic\u00eda Nacional para la b\u00fasqueda, ubicaci\u00f3n y captura de Noriel Chingay, para su internamiento en un penal.<\/span><\/p>\n<p><span style=\"color: #000000;\">En tanto, el abogado Mateo Casta\u00f1eda, presente en la audiencia, qued\u00f3 detenido en el acto.<\/span><\/p>\n<p><span style=\"color: #000000;\">El juez opt\u00f3, en este caso, por efectuar un control difuso constitucional y no aplicar las leyes 32108 y 32138, que tipifican el delito de organizaci\u00f3n criminal, pues, argument\u00f3, \u00abcontravienen la Constituci\u00f3n y afectan derechos fundamentales colectivos de la sociedad\u00bb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Asimismo, se\u00f1al\u00f3 que ambas leyes atentan contra la Convenci\u00f3n Americana de Derechos Humanos y la Convenci\u00f3n de Palermo.<\/span><\/p>\n<p><span style=\"color: #000000;\">Record\u00f3 que los referidos instrumentos garantizan derechos fundamentales colectivos y establecen est\u00e1ndares internacionales para la persecuci\u00f3n del crimen transnacional, respectivamente.<\/span><\/p>\n<p><a href=\"https:\/\/elinformanteperu.com\/wp-content\/uploads\/2024\/08\/poder-judicial-fachada3.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"size-full wp-image-123850 aligncenter\" src=\"https:\/\/elinformanteperu.com\/wp-content\/uploads\/2024\/08\/poder-judicial-fachada3.jpg\" alt=\"\" width=\"500\" height=\"333\" srcset=\"https:\/\/elinformanteperu.com\/wp-content\/uploads\/2024\/08\/poder-judicial-fachada3.jpg 500w, https:\/\/elinformanteperu.com\/wp-content\/uploads\/2024\/08\/poder-judicial-fachada3-300x200.jpg 300w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Lima, 23 Noviembre 2024, (ANDINA).- Poder Judicial, a trav\u00e9s del Primer Juzgado de Investigaci\u00f3n Preparatoria Nacional, dict\u00f3 24 meses de prisi\u00f3n preventiva contra el abogado Mateo Casta\u00f1eda Segovia y 36 meses contra Noriel Chingay Salazar, investigados por organizaci\u00f3n criminal y otro.
